Defendant Thomas E. Greenwald and his insurer are appealing from a judgment on a verdict following a jury trial in the circuit court for Kenosha county. The case arises out of a collision between an automobile operated by the defendant-appellant Greenwald and the plaintiff-respondent Ernst at the intersection of Highways 43 and 31 in Kenosha county at approximately 11:30 p. m. on September 6, 1964. The plaintiff was proceeding north on Highway 31, and the defendant was eastbound on Highway 43. Electric traffic-control signals are installed at this intersection. Neither of the drivers recall any of the details of the accident. However, the defendant Greenwald did testify, although he was not positive of the distance, that when he was about 100 feet from the intersection he observed the stop-and-go lights to be green. Other than the drivers, the only witness was a brother of Greenwald, who at the time of the trial was in the army in Vietnam and was unavailable to testify.
